Unlimited warranty terms and conditions for the battery of a passenger car of trucks

1. Special conditions for the purchased battery

1. The batteries specified in this document, purchased from TEGETA MOTORS LLC (hereinafter referred to as the “Seller”/”Company”) for light vehicles and trucks (hereinafter referred to as the “Products”) are subject to an endless warranty in case of detection of any defect thereon.

2. The warranty conditions apply to the Products purchased and installed in the Company, as defined herein. In the event that the installation of Products purchased from the Company was not carried out by the Seller, the warranty conditions apply in the case of inspecting the installed Products by the Company, provided that the inspection must be carried out no later than 10 (ten) business days from the date of installation. 

 

2. Basic terms for compensation of loss

1. The warranty may apply in the event of complete or partial damage to the battery as a result of external impact, as well as if an electronic malfunction is detected.

2. The special condition includes:    

  • restoring a battery damaged as a result of detection of defects, or
  • compensation to the customer for the damage caused by this case.

 

3. Warranty period

1. Information about applying the endless warranty conditions to the Products will be communicated to the Buyer by sending a short text message.

2. The warranty conditions apply from the moment the Product is transferred to the Buyer’s ownership and installed by the Company. The date of transfer of the Product to the Buyer's ownership shall be indicated by the Seller’s representative in the warranty document, invoice for Product purchase, or proof of Product’s price payment document issued by the Company.

3. In the event that the Products purchased from the Company have not been installed by the Seller, the warranty conditions apply after inspection of the installed Products by the Company.  

 

4. Conditions for Fulfilling Warranty Obligations

1. Warranty obligations of the Seller shall only be triggered if the Buyer submits the damaged Product(s) along with the relevant documentation, such as an identity document and proof of Product’s price payment document, to the Seller.

2. The Seller’s warranty obligations imply the repair of the Product, or the refund to the Buyer of the price of the Product in the amounts specified herein (in the event that the Seller is unable to provide its repair). If the Seller fulfills these warranty obligations, the warranty ceases to be valid for the Products.

3. Direct or indirect financial costs incurred by the Buyer due to malfunction of the Product (during the warranty period) will not be reimbursed by the Seller.

4. The Buyer has the right to claim the provision of warranty service only within the scope of one damage.

5. Damaged Products that have been changed/replaced as a result of warranty service shall be the ownership of the Seller.

6. If the case is considered by the Seller to be a “Warranty Claim”, the Seller will indicate the relevant decision in the complaint form in the Seller’s electronic business management system (SAP). This decision will indicate whether the damaged product will be repaired/restored, or whether the Product’s price will be refunded to the Buyer. During the warranty period, the duration of repairs, or refund of funds will be determined on a case-by-case basis and the Buyer will be preliminarily notified thereon.

7. As a result of studying the circumstances, the Seller makes a decision, at his own discretion, regarding the restoration of damaged Products or the reimbursement of their value to the Buyer in the amount specified in the annex to this document.

8. If the parties are unable to amicably resolve a dispute concerning the Product’s warranty conditions, they should apply to LEPL Levan Samkharauli National Forensic Bureau to investigate the cause of damage. The cost of this examination shall be borne by the Buyer.  

9. The Seller shall be released from warranty obligations if the barcode or serial number or the label of the Product presented is damaged or does not correspond to the number filled in the warranty document in the Seller’s electronic business processes management system (SAP);

 

 5. Refund of the Products’ price to the Buyer during the endless warranty period

1. The endless warranty applies to the following brands: Varta, Exide, Fiamm, Optima, MAN, Energizer, Monbat, Bex, Autopower, Feon, Akom, Monbat, Macpower.

2. Within the framework of this warranty, the amount to be compensated by the Seller for the Products shall be calculated based on the period elapsed since the transfer of ownership of the Products to the Buyer in accordance with the following percentage:

 

 

For the Products of the following brands:

Varta Series for light vehicles: Silver Dynamic AGM, Blue Dynamic EFB, Silver Dynamic and Series for trucks: Promotional AGM, Promotional EFB;

Exide Series for light vehicles: AGM, FB, Premium and Series for trucks: StrongPRO EFB+; Fiamm Series for light vehicles: ecoFORCE AGM; TITANIUM PRO;

 

Energizer Series for light vehicles: GM, EB, Max and Series for trucks: MAX COMMERCIAL; Optima Series for light vehicles: YELLOWTOP, REDTOP, BLUETOP

Macpower Premium Series for light vehicles: En(DIN), JIS, BSI, FB and Truck series: HD SMF MAN, Series for trucks: HD SMF

Monbat Series for light vehicles: GM, EB, Premium and Series for trucks: AGM, HD Ex Series for light vehicles: En, JIS and Series for trucks: HD

Autopower Series for light vehicles: En, JIS and Series for trucks: HD Feon Series for light vehicles: En 6CT and Series for trucks: HD 6CT Akom Series for light vehicles: En, JIS EFB and Series for trucks: HD 6CT
